Kajal Aggarwal loses case against coconut oil company
Aug 11, 2017 JBThe case was regarding a promotional video made in 2008 by VVD & Sons featuring Kajal to promote its products. According to the Thuppakkai actress, it was a matter of convention and custom prevailing in the field that any advertisement/endorsement allowed to be used is permissible only for a year unless and otherwise provided in clear terms. In all other cases renewal is done for the subsequent use of the promotional material. She also stated that the company had violated this basic custom of the industry and had used the video in subsequent years without renewing the contract with her.
But the judge dismissed her suit and stated, "The company is the owner of the copyright as per the agreement entered between the parties. The term of the copyright in the commercial cinematography film is 60 years under the Copyright Act. Therefore, being the absolute owner, the company has not infringed copyright. I therefore hold that Aggarwal is not entitled to damages for the so called misuse and violation of the terms of the contract by the company." Click the Movie button below for more info:
